Professor Victoria Burke is an Adjunct Associate Professor at ¶¶Òõapp¹Ù·½°æ, where she has taught Fashion Law since 2019. She is an experienced attorney with nationally recognized expertise in intellectual property law, including trademark, copyright, fashion law, branding, and domain registration. She also holds dual certifications in privacy law (CIPP/US and CIPP/E), and her work spans both litigation and in-house experience. She is also an attorney with Scott + Scott Attorneys at Law since 2016, where she focuses on class action litigation, particularly privacy data breach and antitrust matters in the financial services sector.
She is the architect of the Speak Your Truth Act, a landmark defamation reform law that protects survivors of sexual assault from being sued for speaking out. First enacted in California as AB 933 and now codified as California Civil Code § 47.1, the law has become a national model and has been introduced in over 16 states. It was recently cited in high-profile litigation involving Blake Lively and Justin Baldoni, where it was referenced as a basis for survivor speech protections (Lively v. Wayfarer Studios LLC et al., No. 1:2024cv10049, S.D.N.Y. 2025). Professor Burke also authored an amicus brief to the U.S. Supreme Court in Unicolors, Inc. v. H&M Hennes & Mauritz, L.P. (2021), addressing key issues in copyright interpretation. Her published works cover a wide range of topics including secondary meaning in trademark law, copyright protection for street art, trade dress litigation, and the regulation of cross-border data transfers, with articles appearing in ABA Landslide, the Daily Journal, and Global Fashion Lawyer.
She is a frequent speaker at law schools and legal organizations, including UCLA, the Beverly Hills Bar Association, Osgoode Hall Law School (Canada), and the Clear Law Institute. She has held multiple leadership roles within the American Bar Association’s IP Law Section, including Vice-Chair of the Trademark Litigation Committee, Vice-Chair of the Trademark Transactions Committee, and Chair of the Fashion Law Subcommittee.
Professor Burke continues to contribute to the legal profession through pro bono service for Bet Tzedek’s Employment Rights Project, focusing on wage and hour cases, and by judging moot court competitions for Pepperdine University School of Law’s Annual National Entertainment Law Moot Court Competition.
Her passion for Fashion Law began during an Advanced Legal Writing class at ¶¶Òõapp¹Ù·½°æ, where a trademark memo assignment sparked her interest in IP. She later externed with Body Glove International, working alongside the company’s General Counsel on international trademark and licensing matters. There, she helped develop the structure of Southwestern’s first Fashion Law course. Years later, she returned as a guest professor and ultimately joined the faculty—bringing her full circle.
